You may use Ember if you:

• Create an Ember account using accurate information.

• Comply with these Terms.

• Follow applicable laws.

• Use the platform respectfully.

Depending on your location, you may need to meet a minimum age requirement or have the permission of a parent or legal guardian.

You are responsible for maintaining the security of your account credentials.

2. Your Ember Account

Your Ember account provides access to Ember products and services.

You agree to:

• Keep your account information reasonably up to date.

• Protect your password.

• Notify us if you believe your account has been compromised.

• Use your account only for lawful purposes.

You are responsible for activities that occur under your account unless those activities result from unauthorized access that is not reasonably attributable to you.

3. Your Content

One of the most important principles of Ember is simple:

Your content remains yours.

When you create stories, journals, memories, photographs, recordings, documents, or other content within Ember, you retain ownership of that content.

Using Ember does not transfer ownership of your work to us.

To provide our services, you grant Ember a limited license to:

• Store your content.

• Process your content.

• Display your content to you and those you authorize.

• Back up your content.

• Synchronize your content across Ember products.

• Use AI services that you choose to enable.

• Generate exports that you request.

This license exists solely to provide the services you ask us to perform.

It ends when your content is permanently removed from

4. Collaboration & Sharing

Many Ember products allow you to invite others to participate in preserving stories and memories.

You control who you invite.

Depending on the product, collaborators may include:

• Partners

• Contributors

• Readers

• Legacy Guardians

• Other roles introduced in future Ember products

Each role is granted only the permissions necessary for its intended purpose.

You remain responsible for choosing who receives access to your content.

Where supported by the product, you may modify or revoke access at any time.

5. Acceptable Use

We ask everyone who uses Ember to treat the platform and each other with respect.

You agree not to:

• Use Ember for unlawful purposes.

• Attempt unauthorized access to other accounts.

• Upload malicious software or harmful code.

• Interfere with the operation or security of Ember.

• Circumvent security measures.

• Misrepresent your identity in a way that harms others.

• Use Ember to violate the rights or privacy of another person.

If necessary, we may suspend or terminate accounts that violate these Terms or place other users or the platform at risk.

6. Subscriptions & Billing

Some Ember products offer optional paid subscriptions that provide access to additional features and services.

Subscription details, pricing, and available plans are described within the applicable product and may change over time.

Payments are processed securely through trusted third-party payment providers.

By purchasing a subscription, you authorize Ember and its payment provider to charge the applicable subscription fees according to the billing terms presented at the time of purchase.

Unless otherwise stated:

• Subscriptions renew automatically at the end of each billing period.

• You may cancel automatic renewal at any time through your account or customer billing portal.

• Cancellation prevents future renewals but does not automatically generate refunds for the current billing period unless required by law or stated in our Subscription & Billing Policy.

• Subscription benefits remain available until the end of the paid billing period.

7. Intellectual Property

The Ember platform, including its software, website, branding, documentation, design, graphics, and related materials, is protected by intellectual property laws.

Unless otherwise noted, these materials are owned by Ember or are used under appropriate license.

These Terms do not grant ownership of Ember's intellectual property.

At the same time:

Your content remains yours.

Nothing in these Terms transfers ownership of the stories, memories, journals, recordings, photographs, or other personal content you create using Ember.

8. Artificial Intelligence

Some Ember products include optional AI-assisted features.

These tools are designed to help organize, summarize, transcribe, improve, or explore the content you choose to create.

AI-generated suggestions are intended as assistance only.

You remain responsible for reviewing, editing, and deciding whether to use any AI-generated output.

While we continually improve our AI features, we cannot guarantee that AI-generated content will always be accurate, complete, or appropriate for every situation.

Ember does not claim ownership of AI-assisted content that you create.

9. Availability of Services

We strive to make Ember available whenever you need it.

However, like any online service, availability may occasionally be affected by:

• Planned maintenance

• Software updates

• Infrastructure upgrades

• Security improvements

• Internet disruptions

• Events beyond our reasonable control

While we work to minimize interruptions, we cannot guarantee uninterrupted access to every service at all times.

10. Suspension or Termination

We hope never to restrict anyone's access to Ember.

However, we may suspend or terminate access to some or all services if reasonably necessary to:

• Protect the security of the platform.

• Prevent fraud or abuse.

• Comply with legal obligations.

• Protect the rights or safety of other users.

• Enforce these Terms.

Where practical, we will make reasonable efforts to notify affected users before permanent account termination.

Users may also choose to close their Ember account at any time, subject to any applicable legal or operational requirements regarding retained information.

11. Disclaimers

Ember is provided on an "as available" and "as provided" basis.

While we work hard to provide reliable services, we cannot guarantee that:

• Services will always be uninterrupted.

• Every feature will always function without error.

• AI-generated content will always be accurate.

• Every service will remain available indefinitely.

Nothing in these Terms limits any consumer rights that cannot legally be excluded under applicable law.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Ember's liability arising from the use of its services is limited to the amount you paid for the applicable service during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes liability where such exclusion is prohibited by law, including liability arising from fraud, intentional misconduct, or other circumstances where limitation is not legally permitted.

13. Changes to These Terms

As Ember grows, these Terms may evolve to reflect new products, legal requirements, security improvements, or changes to our services.

When material changes are made, we will update the effective date and, where appropriate, provide reasonable notice.

Continued use of Ember following the effective date of updated Terms constitutes acceptance of those changes.
